DEW - Enterprise Agreement | Flexitime And Toil Clauses

Public Service Association (PSA) Members have achieved a considerable improvement to the clauses in relation to Flexitime and TOIL (Time off in Lieu of Payment for Overtime) in the South Australian Modern Public Sector Enterprise Agreement: Salaried 2017. These clauses now clearly set out the circumstances of how TOIL can be requested and taken, and also clarifies how Flexitime arrangements can be applied.

These clauses can be found on pages 22-23 of the Enterprise Agreement. A copy of the Enterprise Agreement can be found here. The Enterprise Agreement was approved on 31 January 2018 and therefore these clauses have been in effect since then.

The Department has indicated that systems will be updated to allow for these changes. It is important that any additional hours worked outside of normal working hours are recognised and that both Flexitime and TOIL arrangements are carried out with the agreement of both the Department and the employee.

While the PSA acknowledges that updating systems may take time, staff can expect that any agreed hours worked as part of a Flexitime or TOIL arrangements after the approval of their Enterprise Agreement will be appropriately remunerated for as per their entitlements.
