On Monday 9 December 2019 PSA Worksite Representatives (WSR’s) from Country Arts SA (CASA) along with the Public Service Association (PSA) attended a Conciliation Conference held in the South Australian Employment Tribunal (SAET) facilitated by Commissioner McMahon.

The PSA presented our claim to the Commissioner followed by Country Arts SA’s response.

The PSA is firmly of the view that the contracts CASA is issuing as “fixed term contracts” do not meet the definition of a “fixed term contract”. We say the contracts are merely contracts of administrative convenience, and employees on these recurring contracts are in reality ongoing employees.

After hearing CASA’s response to our claim the Commissioner issued the following agreed recommendations:

  •  That the individual identified at the Conciliation Conference held on 9 December 2019 will have their current contract extended for an additional month. (The new expiry date will now be 31 January 2020)
  • That the PSA will provide a list of any other employees affected in the short term to Country Arts SA within 48 Hours of yesterday’s conference.
  •  That the parties will meet on Wednesday, 15 January 2020 in an effort to seek to resolve their differences.
  •  That the parties will report back to the SAET on Monday 20 January 2020 if the matter remains unresolved.


The PSA will keep members informed of any progress and will notify members of a meeting in the new year.
