MEAL BREAKS/TOIL
MEETING WITH DFC MANAGEMENT

On Wednesday 12 September 2007, the Public Service Association (PSA) met with the Department for Families and Communities (DFC) to discuss the many issues relating to meal break entitlements in Families SA. The PSA was represented by Cavan Worksite Representative Mike Proctor, and PSA Industrial Officers Jean-Guy Townsend and Steve Acton.

There was little progress made. DFC has given a written commitment to "resolve these issues without delay" but did not commit to any time frame. The Department will provide time frames for resolution by week's end. Members should be aware that this issue is almost a year old. The Department has demonstrated an obvious lack of commitment and continues to ask members to "hold off" progressing these issues. Whilst another verbal commitment was given at Wednesday's meeting, DFC seems to underestimate members' resolve to achieve a positive outcome as soon as possible.

There are two distinct issues; one is an Underpayment of Wages, and the other is negotiating a new arrangement to work through meal breaks.

  • The Underpayment of Wages is clear cut. Should a worker not have a break during their shift, then a half hour TOIL is accrued per shift. This has been a condition of employment since the 2001 EA.

  • Negotiating a Workplace Flexibility Proposal, section 19.1.2 of the 2006 EA. BOTH parties must agree to any new proposal.

The PSA will inform members of the Department's time-line on Friday 14 September 2007.
