HISTORIC MATERNITY LEAVE DECISION

The Full Bench of the South Australian Industrial Relations Commission today handed down a historic decision awarding 12 weeks paid maternity/adoption leave for PSA members in the SA public sector. The decision is effective from today. The full text of the decision is available here.

Members are currently entitled to 4 weeks, with the Government having offered only 8 weeks which was conditional upon the acceptance of a low salary offer. Members rejected this earlier Government proposal overwhelmingly in a ballot last year. After refusing to negotiate, the Government referred the claim for maternity leave and salary increase to the Industrial Relations Commission.

The PSA claimed 14 weeks paid maternity leave in August 2003. PSA presented an extensive case to the Full Bench in support of this claim, including evidence from expert witnesses and advocacy of the PSA case by Queen’s Counsel.

PSA General Secretary, Jan McMahon said;

The Industrial Commission’s decision clearly recognises the important contribution that women make to the workforce and the community, and understanding of the effects of child birth on both the mother and the community.”

The Commission’s decision today is historic, particularly in view of the Government’s refusal to negotiate.”

PSA wishes to express its appreciation to those members who provided support throughout this matter.

The Full Bench will hand down its decision regarding the salary component of the Arbitration at a future date.
