YOUR RIGHTS AT WORK

The South Australian State Government ensured the Federal Government's draconian "Work Choices" legislation which gave employers the opportunity to reduce hard won conditions of employment, will not apply to PSA members employed under the PSM Act, South Australian Health Commission Act and IMVS Act.

However, the PSA is concerned that some Chief Executives and Managers are attempting to reduce members' rights and conditions of employment in response to the Government's insistence on budget cuts.

Conditions under threat include:-

  • Not classifying employees in accordance with award (Employer has stated "There is to be no management initiated reclassifications”.)

  • No payment for employees performing higher duties. (Employer has stated "There is to be no payment made for higher duties”.)

  • Not replacing staff on leave.  This has the potential to subject remaining staff to unreasonable workloads which is a breach of the 2006 Wages Parity Enterprise Agreement. (Employer has stated "No replacement of staff on leave.")

  • Requiring members to work in excess of 7.5 hours in a day and not paying overtime as required by the Award, nor paying Tea Money if they work 2 hours or more passed their normal finishing time.

Members are reminded that all of the above matters are included in awards and agreements and failure to comply is a breach of the award and agreement.  In some cases this could result in "Under Payment of Wages" which then could be the subject of a formal dispute.

The PSA will be challenging Chief Executives whenever there is an attempt to implement processes which breach awards and agreements.
