ONGOING WORKERS COMPENSATION PAYMENTS
As
members would be aware in 2008 the Rann Labor Government changed the
Workers Compensation Legislation to reduce workers' entitlements.
One of the most significant changes is the loss of weekly income payments after two years, except if you have no work capacity or you have maximised your capacity. The PSA believe that these changes are unfair. Under the old Workers Compensation system, if a person was injured at work, and could no longer work at the pre-injury level they could have been rehabilitated in a lower level position and receive make up pay. Under the new legislation they will be penalised for taking these lower level positions. This is despite the fact that it is the agency who organise the placement in the lower level position and the injured worker had no option but to take the offered lower level position. In these situations after two years the worker will no longer receive the make up pay. The PSA can provide advice to any members in this situation. However the legislation has changed and there are no longer entitlements to ongoing Workers Compensation. Members should be aware that this change to Workers Compensation entitlements was in no way supported by the PSA. The previous entitlement can only be restored by a change to the Workers Compensation Legislation.
