INDUSTRIAL ACTION AT UNIVERSITY OF SOUTH AUSTRALIA 16 SEPTEMBER 2009
The NTEU have advised that industrial action by their members will
commence with a 24 hour strike on Wednesday 16 September 2009.
CPSU policy is that our members do not pick up the duties that are part
of bans by any other union. Please refer to previous Brief Enterprise
Bargaining Update No.9 dated 7/9/09.
CPSU contacted UniSA Human Resources regarding the statement in their
email that only NTEU members can strike. CPSU advised Human Resources
that this is contrary to the legal advice received by the CPSU from the
Federal office. UniSA Human Resources have advised that no sanctions
will be taken against members of staff who strike in support of the
industrial action on this day other than loss of pay. The UniSA Human
Resources emphasised that the university respects the right of staff to
participate in industrial action.
The intent of UniSA management in putting out their email was to ensure
that the University management comply with their legal obligations as
contained in the Fair Work Act. It is unlawful for UniSA to pay staff
and unlawful for staff to accept payment if they participate in certain
periods of industrial action.
