HIGH COURT CASE STARTS

The High Court will commence hearing the Public Service Association’s case regarding the jurisdiction of the Supreme Court of South Australia to deal with matters arising from the 2010 Budget tomorrow, Tuesday 29 November.

Together with a legal team, PSA is being represented by President Lindsay Oxlad, General Secretary Jan McMahon and Chief Industrial Officer Peter Christopher.

Former Treasurer Kevin Foley removed Recreation Leave Loading and reduced Long Service Leave entitlements for PSA members despite the protection of existing conditions in an Enterprise Agreement, certified only in January 2010.

The Industrial Relations Commission and the Supreme Court of South Australia have both previously determined that they lack jurisdiction to hear the matter.

The PSA’s legal team, headed by Mr Paul Heywood-Smith QC, will argue that jurisdiction does exist.

“The Public Service Association will leave no stone unturned, including using all available legal avenues, to defend members’ entitlements which were protected by an Enterprise Agreement.” said Jan McMahon, General Secretary.
