WORK CHOICES UPDATE.
The High Court challenge to the Work Choices legislation is currently
underway. Although the case is expected to conclude within a few days, a
decision is not likely for some time.

It is important to recognise that the High Court challenge does not deal
with the merits or otherwise of Work Choices, but only the issue of
whether or not the Commonwealth Government has the Constitutional
authority to make such law.

PSA has secured protections for members through an undertaking by the
State Government that it will continue to provide existing benefits in
the SA public sector as a matter of policy, even where such protections
are prohibited from Agreements. A copy of advice from Minister Michael
Wright is on the PSA web site here.

Please note that this undertaking relates to the SA public sector only
and does not apply to members employed within Universities. The High
Court outcome will affect all members.
